A court for the Southern District of Texas granted an insurer's motion to abate extra-contractual claims in UM/UIM lawsuit and sua sponte ruled the insured's breach of contract claim to be unripe pending the outcome of the insured's declaratory judgment action on the UM/UIM claim.
